BY ENTERING INTO OR PARTICIPATING IN THE PROGRAM, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES, WHICH CONSTITUTE A CONTRACT, SO READ THEM CAREFULLY, IF YOU DO NOT AGREE WITH THE TERMS OF THIS CONTRACT, DO NOT ENTER THE PROGRAM.

Sponsorship: The 2024 Sun-bassador Program (the "Application") is sponsored by Sun Outdoors, a division of Sun Communities Inc. (SUI) ("Sponsor") with a principal address of 27777 Franklin Road, Suite 300, Southfield, Michigan 48034 ("Sponsor's Location"). The Sweepstakes is governed by these Official Rules. By participating in the Application, you agree to be bound by these Official Rules and the decisions of the Sponsor (including Sponsor's interpretation and application of these Official Rules), which are final and binding. Being selected is contingent upon fulfilling all requirements set forth in these Official Rules in a timely manner.

Eligibility: The application is open to all natural persons who (a) are residents of the fifty (50) United States, the District of Columbia, or Canada (excluding the Province of Quebec) and (b) at the time of entry, and are 21 years or older. Applicants must have an active, public Instagram account (TikTok and YouTube accounts are optional) and be open and willing to visit Sun Outdoors resorts throughout 2024 to qualify.

How to Enter: During the Entry Period (as herein defined), Participants may enter by filling out the online application form.  Each applicant is referred to herein as a "Participant". One entry per person during the Entry Period. Use of any automated system to participate is prohibited and will result in disqualification. Entries that are incomplete, illegible, misspelled, damaged, destroyed, late, misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes, at the Sponsor's sole and absolute discretion. Attempts made by the same individual to submit multiple entries by using multiple emails, addresses, accounts or other means may be disqualified. Entries generated by any automated means are void and may be disqualified. 

Application Period: The Application will open on 11/1/2023 at 12PM ET and end on 12/1/2023 at 12PM ET, unless earlier terminated or canceled by Sponsor (the "Application Period").

Selection. The review and selection will be conducted by a representative of Sponsor from all eligible entries received during the Entry Period (the "Selection"). The potential Sun-bassadors will be selected on or before 12/15/2023, (the "Selection Date").

Announcement of Sun-bassadors. Sun Outdoors will announce the selections on their Instagram channel by tagging them in an Instagram Story and sending an email to the address from the Participant's application. The Selection Notification will include information on contacting Sponsor to claim the applicable Prize (as defined below). 

To claim status as a Sun-bassador, the potential selection must reply to the Sponsor within two (2) days of the Selection Notification being sent, or as otherwise directed in the Selection Notification. If the potential Sun-bassador does not respond to the Sponsor's Selection Notification email within two (2)days of the Selection Notification being sent or if the notification is rejected, faulty, unclaimed or returned undeliverable (for any reason whatsoever) to such potential winner, the potential winner may be deemed to have forfeited the selection, and Sponsor will have the sole and absolute discretion to select, by careful review, another potential Sun-bassador from the remaining eligible entries.

Odds of Selection and Claiming Status. By entering this promotion, Participant is eligible to become a Sun-bassador for the duration of 2024 and receive a sponsored swag package, along with a promo code for savings of 40% on bookings at select Sun Outdoors resorts throughout the year (restrictions may apply). A Sun-bassador may not request cash or a substitute compensation; however, Sponsor reserves the right to substitute the Prize with another prize of equal of greater value if the Prize is not available for any reason, as determined by Sponsor in its sole discretion. The approximate retail value of the swag package Prize is approximately $100 (United States Dollars).

It is the Participant's responsibility to read and understand all information, if any, which accompanies any Prize concerning use, risks, and maintenance. Winning Participant may allow guests to accompany winning Participant, provided that: (i) the number of guests will be limited depending on the capacity of the rental or site chosen by winner; (ii) winning Participant and any guests of a Participant must comply with all on-site rules related to use and occupancy of the Prize; (iii) winning Participant's permitted guest(s) must be the age of majority in the guest's state of residence, unless winning Participant is the guest's parent or legal guardian; and (iv) winning Participant and his/her guests must complete, sign, have notarized and return a release of liability and, where legal, a publicity release to Sponsor in the timeframe specified by Sponsor or use of the Prize will not be allowed. Once selected by winning Participant, a guest cannot be changed without the express consent of Sponsor, which may be withheld for any reason.

All costs and expenses associated with a Participant's acceptance and use of a prize not specified herein as being provided as part of the prize are the sole responsibility of the winning Participant. For purposes of clarity, airfare, meals and other travel costs are NOT included in the Prize, and are the sole responsibility of Participant.

Winner will be required to verify eligibility. 

Release & Indemnity. To the fullest extent permitted by law, Participants forever release, discharge, and covenant not to sue Sponsors and subcontractors and each of their respective owners, employees, agents, directors, officers, shareholders, contractors, successors and assigns (collectively "Released Parties") for, from and against, any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions, causes of action whatsoever, of every nature, character and description (collectively, "Claims"), known and unknown, arising out of or in any way related to the Sweepstakes, these Official Rules, the negligence of any of the Released Parties, entry into the Sweepstakes and the acceptance, possession, misuse or use of any Prize. By participating in the Sweepstakes, each Participant also agrees to indemnify, defend, release, discharge and hold harmless Released Parties from any and all Claims of any kind whatsoever for injuries, death, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use or misuse of any Prize by Participant and Participant's guests and invitees, including without limitation, claims for breach of contract, infliction of emotional distress, defamation, false light, common law or statutory misappropriation, invasion or other violations of any actual or purported right of privacy and/or publicity, and claims under equivalent federal, state or provincial laws arising from participation and any exploitation of any or all of the rights granted to Sponsor. In addition, each Participant acknowledges and agrees that the Released Parties are not responsible for any costs, injuries, losses, or damages of any kind arising from or in connection with: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible or misdirected entries; (ii) any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or discontinued; (iii) any failure to receive or process entries due to any cause, including without limitation, human, transmission or technical problems, failures, or malfunctions of any kind, howsoever originating, that may limit an participant's ability to participate in the sweepstakes including any interruptions to any network, server, Internet, website, telephone, satellite, computer or other connections; (iv) garbled, misdirected or jumbled transitions, or traffic congestion; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from entry into or participation in the promotion (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the participant's rights of publicity or privacy, or the participant's claim that they have somehow been defamed or portrayed in a false light); (vi) any printing or typographical errors in any materials associated with the promotion, (vii) human error and other errors; or (viii) late, lost, delayed, or damaged delivery of the prize.

TO THE FULLEST EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES WILL A WINNER BE PERMITTED TO OBTAIN AWARDS FOR, AND EACH PARTICIPANT AND WINNER HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES ARISING OUT OF OR RELATED IN ANY WAY TO THE SWEEPSTAKES, THESE OFFICIAL RULES, PARTICIPANT'S ENTRY, THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES, AND THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF ANY PRIZE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO EACH PARTICIPANT.

PARTICIPANTS UNDERSTAND THAT EACH PARTICIPANT IS WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED, AND IN ACCORDANCE WITH SUCH WAIVER, PARTICIPANT ACKNOWLEDGES THAT PARTICIPANT HAS READ AND UNDERSTANDS, AND HEREBY EXPRESSLY WAIVES, THE BENEFITS OF SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA, AND ANY SIMILAR LAW OF ANY STATE, COUNTRY OR TERRITORY, WHICH PROVIDES AS FOLLOWS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR."

Use of Disclosed Information. By filling out the Application or claiming a Prize, Participant and/or Sun-bassador may be sharing their personal information with Sponsor. Information transmitted to Sponsor will generally be treated as non-confidential and non-proprietary. By applying, Participant consents to Sponsor sending to Participant's e-mail address or home address promotional content.  By entering into the Sweepstakes, Participant agrees to Sponsor's privacy policy, which is available at https://www.suncommunities.com/privacy-policy/. If you do not wish to receive these communications, you may "opt out" by following the instructions in the privacy policy.  Please note, however, that if you "opt-out" of receiving communications, Sponsor may still contact concerning the Application including notifying you if you are a potential selection. By applying to the program or claiming a prize you consent to Sponsor's use of each winner's name, biographical information and/or likeness for online posting and/or any other written or photographic advertising and publicity without additional compensation, except where prohibited by law. 

For Canadian residents: By applying to the program, you: (i) grant to Sponsor the right to use your name, mailing address, telephone number, and e-mail address ("Personal Information") for the purpose of administering the program, including but not limited to contacting and announcing the Sun-bassadors; (ii) grant to Sponsor the right to use your Personal Information for publicity and promotional purposes relating to the program, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledge that Sponsor may disclose your Personal Information to third-party agents and service providers of Sponsor in connection with any of the activities listed in (i) and (ii) above.

Reservations. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the program at any time for any reason in its sole discretion, which shall be final. All Participants agree to abide by and be bound by these Official Rules. Sponsor reserves the right to permanently disqualify and/or revoke a prize from any person it believes has violated these Official Rules or has acted in a manner that is, in Sponsor's discretion, offensive, harassing, threatening, repugnant, or violent at any time, including any tampering with the entry process. Participants further agree to not knowingly damage or cause interruption of the program and/or prevent others from participating in the program. All decisions of Sponsor shall be final and Participants waive any right to challenge any decisions made by Sponsor.

Governing Law/Venue. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the Participants or Sponsor in connection with the program shall be governed by and construed in accordance with the laws of the State of Michigan and the United States of America, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's or country's laws, and any matters or proceedings which are not subject to arbitration as set forth in these Official Rules and/or for entering any judgment on an arbitration award, shall take place solely and exclusively in courts located in the State of Michigan. All matters involving the Sweepstakes and these Official Rules shall be resolved individually, without resort to any form of class action and all damages, claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (excluding any attorneys' fees). 

Social Media Disclosure. Although this promotion may be advertised on Facebook pages, Twitter accounts, Instagram accounts, YouTube channels or other social media platforms of Sponsor and others, this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram, YouTube or other social media platforms. Participants are providing their information to the Sponsor and not to Facebook, Twitter, Instagram, YouTube or other social media platforms. The information a Participant provides will only be used by the Sponsor and its agents. By entering, Participants provide a complete release of Facebook, Twitter, Instagram or YouTube from any and all responsibilities implied or provided by the Sponsor and that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or YouTube.

General. By filling out the Application, Participants agree to be bound by these Official Rules and any determinations of Sponsor, as determined in its sole discretion, on all matters relating to the program, and to any Prize, all of which are final and binding. In the event that Sponsor is prevented from continuing with the program, or the integrity and/or feasibility of the Sweepstakes as planned is undermined by any event including but not limited to any error, virus, bugs, non-authorized human intervention, action of Participants or other causes beyond the control of Sponsor that corrupt or impair the administration, security, fairness or proper play of the program, or any fire, flood, weather event, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, or order of any court or jurisdiction, Sponsor shall have the right, in its sole discretion, to disqualify you and to abbreviate, modify, suspend, cancel or terminate the program.
